IRS, West Virginia Release Millions in Greenbrier Tax Liens

WHITE SULPHUR SPRINGS — Owners of The Greenbrier resort have been released from millions of dollars in federal and state tax liens following a roughly $500 million financial deal between U.S. Sen. Jim Justice and his family and New York-based Kennedy Lewis Investment Management.

The IRS on Sept. 3 released federal liens totaling about $3.3 million against Greenbrier properties, along with a $289,893 lien involving The Greenbrier Clinic. The West Virginia Tax Division also withdrew nine liens totaling about $3.9 million that same day. The liens had been filed over unpaid taxes, with the IRS previously stating that payment had been demanded but remained outstanding.

Lloyd Nathan, chairman of Greenbrier Holdings LLC’s board, said the releases demonstrate progress toward improving the resort’s financial position.

“The release of these liens is another positive step forward for The Greenbrier and reflects the continued progress being made to strengthen the resort’s financial position,” Nathan said according to WV MetroNews.

Charleston attorney Steve Ruby, who represents the Justice family, said last month that the Kennedy Lewis transaction allowed millions of dollars in tax debt to be paid, calling the resolution one of the deal’s “many, many upsides” and benefits.
