McCuskey Wins Challenge to New York Climate Superfund Law

CHARLESTON — West Virginia has prevailed in its legal challenge to a New York law that sought to impose financial penalties on energy producers for greenhouse gas emissions, marking the first successful challenge to the legislation, state Attorney General J.B. McCuskey’s office announced.

The U.S. District Court for the Northern District of New York ruled in favor of West Virginia in its challenge to the Climate Change Superfund Act. According to McCuskey’s office, the law could have imposed as much as $75 billion in penalties on energy producers nationwide, including coal and natural gas companies operating in West Virginia. Chief Judge Brenda Sannes determined the law exceeded the authority of New York state law and was inconsistent with the federal Clean Air Act. McCuskey filed the lawsuit in February 2025, and arguments were heard in late July from West Virginia, members of the Trump administration and representatives of the energy industry.

McCuskey’s office said the ruling prevents New York from imposing costs on energy production that occurred legally in the past and could have affected West Virginia’s energy industry and consumers. The attorney general’s office also argued that similar climate-related laws could increase energy costs and shift production to countries with fewer environmental regulations. West Virginia is separately challenging a similar measure enacted in Vermont.
